  1. Liability Waiver:

    On behalf of myself and the player being registered, I recognize that baseball entails serious risks. Consequently, except as noted below, I and the player being registered relinquish all rights to a claim of any kind, including the right to a claim for bodily and material damages, regardless of the cause, against the OASA, its member associations, including Wyevale Tribe and their respective officers, employees, coaches, umpires, assignees, agents, representatives, and sponsors, even if such damages result from negligence of the OASA, its member associations, including Wyevale Tribe and their respective officers, employees, coaches, umpires, assignees, agents, representatives, and sponsors.

    Without restricting the generality of the preceding, I and the player being registered also relinquish the right to any claim against the OASA, its member associations, including Wyevale Tribe and their respective officers, employees, coaches, umpires, assignees, agents, representatives, and sponsors resulting from a decision on their part, regardless of the nature of this decision.

    This release of the OASA, Wyevale Tribe and the other persons noted above does not preclude myself or the player being registered from making a claim under any sports accident coverage provided by the OASA and/or Wyevale Tribe to their players.  An overview of the current sports accident coverage provided by OASA can be found at oasa.ca.

  4. WE WOULD LIKE TO CONTACT YOU VIA EMAIL:

    To improve our communications and service we would like to correspond with you via email. In order to comply with Canadian legislation relating to commercial electronic messages, we are seeking your consent to communicate with you via electronic messages, including email, related to your relationship with Wyevale Tribe Minor Softball including team selection, program, membership, promotional materials and other Wyevale Tribe Minor Softball information. You may choose not to receive these communications at any time by clicking the unsubscribe link within one of our email newsletters.
  5. Photo Consent:

    I authorize Wyevale Minor Tribe Softball and/or its staff, associates, assistants, or subcontractors to use photograph(s), video and other media images provided for any Wyevale Tribe Minor Softballs promotional, educational or other pertinent uses. I also agree to Wyevale Tribe Minor Softball using any images of the named minor(s) gathered by photographers, and or videographers supplying images to Wyevale Tribe Minor Softball.

    These images may include, but are not exclusive to, club, coach, athlete and/or parent, and/or volunteer submissions by various member associations of Wyevale Minor Tribe Softball.

    I authorize Wyevale Tribe Minor Softball to permit the use and display of photographs and/or recordings of the named minors in any Wyevale Tribe publication, multimedia production, including video and web usage, display, or advertisement.

    I agree that Wyevale Tribe Minor Softball may use name, likeness, or information supplied by the undersigned.

    The undersigned releases and forever discharges Wyevale Minor Tribe Softball and its officers and employees from any and all claims and demands arising out of or in connection with the use of said photographs / recordings, including but not limited to, any claims for invasion of privacy or defamation.
  6. Rowan’s Law:

    Under Rowan's Law, before any player can be registered with the local association and Baseball Ontario, the player, and the parent or legal guardian of the player if the player is under 18 years of age, must review one of the Concussion Education Resources provided by the Province of Ontario and must review the Player Code of Conduct.     Rowan's Law Acknowledgement:

    I hereby confirm that the player being registered to participate in baseball activities with the Wyevale Tribe Minor Softball and the OASA, and the parent or legal guardian of the player being registered if the player is under 18 years of age, have reviewed one of the concussion education resources provided by the Province of Ontario as referenced above and have reviewed the player code of conduct as referenced above. I / we further acknowledge understanding the nature and risk of concussion and head injury to athletes, including the risks of continuing to play after a concussion or head injury is suspected.
  7. COVID RELATED - PARTICIPANT AGREEMENT

    1. I acknowledge that the World Health Organization has classified the Coronavirus Disease ("COVID-19") outbreak as a global pandemic and am aware of the risks of COVID-19. I specifically acknowledge and agree that I am are aware of the risks to personal health, including by the failure to follow physical distancing protocols, flowing from COVID-19, and that I am assuming, on my own behalf and all health risks and adverse health related consequences caused by or arising from engaging in any Activities (the "Assumed Risks").

    2. I acknowledge that the Wyevale Tribe Minor Softball Association and/or the Organizers are implementing Physical Distancing Rules and/or Return to Play Protocols ("Protocols"). I specifically acknowledge and agree that I am aware of Protocols, that I will abide by the Protocols, and that the Protocols are subject to all federal, provincial and municipal laws, regulations, by-laws and orders as they may exist from time to time.

    3. I hereby release the  Wyevale Tribe Minor Softball Association and the Organizers, their members, officers, directors, employees, independent contractors, agents, and volunteers ("Releasees") from all liability, recourse, proceedings, claims, and causes of action of any kind whatsoever, in respect of all damages, personal injuries, death, or property losses which I may suffer arising out of or connected with the Assumed Risks, the content or implementation of the Protocols (including without limitation the conduct of any screening of any individual), and the preparation for, or participation in, the Activities, notwithstanding that any such losses were caused solely or partly by the negligence of any of the Releasees.

    4. I do hereby agree to indemnify and hold harmless the Releasees from any and all damages or losses of any kind as a result of any and all claims, demands, causes of action of any kind whatsoever including those involving negligence on the part of any of the Releasees that may be made or initiated by, or on behalf of me, arising out of or connected with the Assumed Risks as they relate to me, the content or implementation of the Protocols as they relate to me, and my preparation for and/or participation in any of the Activities.

    5. And, I hereby acknowledge and agree:

    (a) that I understand that none of the Releasees assumes any responsibility whatsoever for my safety during the course of any preparation for or participation in the aforesaid Activities;

    (b) that I will comply with the implementation of the Protocols and that any failure on my part to comply with the Protocols and their implementation may have consequences (including without limitation a withdrawal of permission for me to participate in an Activity or Activities) and could jeopardize relevant insurance coverage;

    (c) that I understand that the implementation of the Protocols may involve the collection, use and disclosure of personal information about me and I consent to same;

    (d) that I have carefully read this ACKNOWLEDGEMENT, RELEASE, INDEMNITY, AND ASSUMPTION OF RISK that I fully understand same, and that I am freely and voluntarily executing same;

    (e) that I have been given the opportunity and that I am encouraged to seek independent legal advice prior to signing this document;

    (f) that I understand that the Organizers would not permit me to participate in any Activities unless I signed this ACKNOWLEDGEMENT, RELEASE, INDEMNITY, AND ASSUMPTION OF RISK, which applies to all Activities whether occurring in the near or distant future and that the terms of this document need not be brought to my attention each time I participate in Activities in order for it to be effective;

    (g) that the term Activities as used herein includes, without limiting the generality of that term, training sessions, clinics, games, tournaments, programs and events that are in any way authorized, sanctioned, organized or operated in or by the Wyevale Tribe Minor Softball Association and/or any of the Organizers on its own or together with another;

    (h) that this ACKNOWLEDGEMENT, RELEASE, INDEMNITY, AND ASSUMPTION OF RISK agreement is binding on myself, my heirs, my executors, administrators, personal representatives, and assigns.
